"I've Got Talent" - OFFICIAL CONTEST RULES

 

 

ELIGIBILITY 

THIS CONTEST CONSTITUTES A FULL AND UNCONDITIONAL AGREEMENT WITH AND ACCEPTANCE OF THE OFFICIAL CONTEST RULES & REGULATIONS.  "I've Got Talent" Contest is being administered by SaltWater Community Association Inc., a registered Not For Profit, NL - License #84490.

The Contest is only open to legal residents of Canada ( excluding residents of the Province of Quebec).  There is NO age restrictions to enter the contest, however individuals under the age of majority (19) in their province of residence require consent from their parent(s) or guardians to register for the Contest.  IF, the GRAND PRIZE winner is under the age of majority their parent(s) or guardian must sign a release to receive the grand prize of 10% of proceeds up to $10,000 maximum.

 

This contest is NOT promoting any organization, therefore under the Competition Bureau of Canada it is not deemed a promotion. 

There is an element of skill (your video of your talent shows the time and effort to develop your talent).  This is NOT a random draw, the element of luck is removed therefor this contest is NOT A RAFFLE or LOTTERY as per Service NL regulations and/or Consumer Affairs' Division.

Volunteers, Officers, Directors, Members, Agents and their immediate family members (including those with whom they are domiciled) of SaltWater Community Association Inc., are not eligible to enter the Contest.   For purposes of this Contest, “immediate family members” shall include the mother, father, brothers, sisters, daughters, sons, partner or spouse of an individual (regardless of where any such “immediate family member” resides).  Determinations of eligibility shall be made in the sole discretion of SWCA..

 

"I've Got Talent" Contest shall determine entry eligibility in its sole and absolute discretion.  By submitting a video and registration fee, each entrant is confirming that he/she is the rightful owner of the video and that the entrant is not submitting it for the owner without his/her explicit consent.  

Video entries are void if the video violates or infringes upon another person's rights, including but not limited to copyright; videos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content; images that involve putting any individual or other enity in danger or deemed inappropriate by the Contest and/or SaltWater Community Association Inc.

Entrants who submit a video and registration fee to: I've Got Talent Contest irrevocably agree to grant "I've Got Talent" Contest and/or SaltWater Community Association Inc., a royalty-free, nonexclusive right for the duration of "I've Got Talent" Contest  to display their video on the submission website' www..saltwater-ca.com well as share the video on the following social media platforms: Twitter, Facebook, and Instagram, for the purposes of the Contest.

 

If honored by the competition as a winner or an honorable mention, you grant;" I've Got Talent" Contest and/or SaltWater Community Association Inc. the right, in perpetuity, to: use the video and/or owner(s) name on SWCA's website, any/all media including; magazines, newspapers, TV, Radio, media outlets, etc., in support of "I've Got Talent"  Contest and/or SaltWater Community Association Inc.'s Mission;

HOW TO ENTER

$10.00 REGISTRATION FEE REQUIRED. 

During the Contest Period, each Entrant must complete the following steps to register an entry into the Contest:

  • Complete the Registration Form (include all pertinent information)

  • Upload your video to the registration form.

  • Entrant is responsible to fill out all required information, including email address, on the Registration Form 

  • E-Transfer the $10.00 registration fee once you have submitted your Registration Form 

 

CONTEST DURATION

 

I've Got Talent" Contest runs from April 10th, 2020 to June 30th, 2020 at 11:59 p.m. EST,   

CANCELLATION/REFUND POLICY

"I've Got Talent" Contest NL and/or SaltWater Community Association Inc. has the absolute right to cancel the contest if there is insufficient interest and/or less than 1,000 registrations for the  Contest 

In the event of cancellation due to insufficient interest (less than 1,000 registrations) a $4.00 administration fee will be deducted from the $10. registration fee from each participant and $6.00 will be refunded per registration.

PRIZE/WINNER

Grand Prize Winner will receive 10% of net proceeds up to $10,000 maximum . and will be required to answer a skill testing question.  The prize is non-transferrable.   

JUDGING

Each entry will be given a number, names will be removed/withheld from the panel of 4 judges to ensure full and equal consideration of all entries.  Judges will select the top 50 Video's.   These 50 videos will be uploaded to our website for the public to vote on and will be identified by a number (no name).  Online voting will commence on July 1st, 2020 and will conclude with on July 15th, 2020.  The Grand Prize winner will be notified on or about July 30th, 2020.

Judging criteria consists of;

- Talent (singing, acting, dancing)

- Visual appeal

- Marketability

- Video must have; good colour, lighting, exposure and focus

- Composition

I've Got Talent" Contest and/or SaltWater Community Association respects your right to privacy.   By accepting the Prize, the Grand Prize Winner agrees to allow  I've Got Talent" Contestand/or SaltWater Community Association Inc., and their respective subsidiaries and affiliates, promotional and advertising agencies and representatives the right to use his/her name, biographical information, image, photos and/or likeness and statements for programming, promotion, trade, commercial, advertising and publicity purposes in connection with  "I've Got Talent" Contest, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on television, video, the World Wide Web and Internet, without notice, review or approval and without additional compensation, except where prohibited by law.

Personal information collected from Entrants will only be used by; I've Got Talent" Contest and/or SaltWater Community Association Inc.  to administer the Contest and, only if consent is actively given at the time of entry, to provide Entrants with information regarding upcoming promotions and/or events from SWCA..  

 

CONTEST ADMINISTRATION

"I've Got Talent" Contest administration will be the sole responsibility of SaltWater Community Association Inc..  All decisions regarding the Contest will remain with SaltWater Community Association Inc. and  they reserve the right, in their sole discretion, to modify, cancel, suspend and/or terminate any or all parts of "I've Got Talent" Contest should there be insufficient interest (less than 2,000 registrations) or any other reason beyond SaltWater Community Association Inc's control.

SaltWater Community Association Inc. reserves the right, in its sole discretion, to disqualify any individual found to be in violation of "I've Got Talent" Contest Official Rules.  SaltWater Community Association Inc. reserves the right to refuse an Entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter "I've Got Talent" Contest". . Any attempt to tamper with the entry process, interfere with these Official Rules, deliberately damage the Apps or any website or undermine the administration, security or legitimate operation of "I've Got Talent" Contest, is a violation of criminal and civil laws, and SaltWater Community Association Inc. reserves the right to seek damages and/or other relief (including attorneys’ fees) from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying Entrants from this and future contests of SaltWater Community Association Inc.   In its sole determination, SaltWater Community Association Inc. may disqualify any person who acts in any manner to threaten or abuse or harass any person and to void all such person’s associated entries in "I've Got Talent" Contest..  SaltWater Community Association Inc. reserves the right, in its sole discretion, to terminate or suspend the Contest should fraud, virus, bugs, or other reasons beyond the control of SWCA corrupt the security or administration of the Contest.

Participants understand and agree that by submitting their registration form, video and fee that they have read or have had someone read the Official Rules and Regulations of "I've Got Talent" Contest to them and they understand and agree to abide by the Official Rules of "I've Got Talent"  Contest as outlined under Official Contest Rules.

 

RELEASE AND LIMITATIONS OF LIABILITY

 

By entering, registrants/entrants agree to release and hold harmless "I've Got Talent" Contest and/or SaltWater Community Association Inc., their respective parent, subsidiaries, affiliates, endorsers and each of their respective officers, directors, employees, volunteers and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in "I've Got Talent" Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Video Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the Contest; or (f) injury or damage to persons or property. You waive the right to claim any legal fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Privacy and Publicity any information you submit as part of  "I've Got Talent" Contest will be used in accordance with SaltWater Community Association Inc's Privacy Policy. Except where prohibited, you consent to SaltWater Community Association Inc's use of your name in any list of Contest Winner (if applicable) and for promotional purposes in any media without further payment or consideration.

 

Disputes; You agree that any and all disputes, claims and causes of action arising out of, or connected with, "I've Got Talent" Contest shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Newfoundland & Labrador. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, your rights and obligations, or the rights and obligations of SaltWater Community Association Inc. in connection with "I've Got Talent " Contest shall be governed by, and construed in accordance with, the laws of Newfoundland & Labrador, without giving effect to any choice of law or conflict of law rules (whether of  Newfoundland & Labrador or any other jurisdiction), which would cause the application of the laws of any jurdisdiction other than Newfoundland & Labrador.  SaltWater Community Association Inc. makes every effort to ensure there are no Errors or Ommissions, and will not be held accountable for any such issue/obligations that may be beyond their control.
